Foodxpress1. Acceptance of these terms
By creating an account, placing or accepting an order, requesting a delivery, or otherwise using Foodxpress, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the services.
2. Eligibility and accounts
You must be legally able to enter into a binding agreement in your jurisdiction. You must provide accurate, current information and keep your login credentials secure. You are responsible for activity carried out through your account and must notify Foodxpress promptly if you suspect unauthorized access.
3. The Foodxpress platform
Foodxpress provides technology that connects customers and senders with participating restaurants, merchants, and delivery partners. Availability, operating hours, product selection, prices, delivery areas, and delivery times may vary. Unless expressly stated otherwise, participating merchants and independent delivery partners are responsible for the goods and delivery services they provide.
4. Food and merchant orders
You are responsible for reviewing your order, delivery address, contact details, allergies, and special instructions before submission. Merchants may accept, reject, substitute, or cancel items when permitted by the app or required by availability. Images and descriptions are illustrative, and actual items may differ.
5. Food, groceries, hardware and pharmacy orders
You must provide accurate order, recipient and delivery information and review merchant-provided product details. For food and groceries, disclose allergies or dietary concerns directly to the merchant and inspect delivered items promptly. Hardware products must be used according to manufacturer instructions and may require safe handling or an adult recipient.
Foodxpress does not diagnose, prescribe or provide medical advice. A participating pharmacy is responsible for lawful dispensing and deciding whether a prescription, identification, age verification or authorized recipient is required. Controlled, prescription-only, refrigerated or otherwise regulated products may be unavailable or subject to additional procedures.
You must not order or send illegal, dangerous, hazardous, stolen, restricted, counterfeit or improperly packaged items. Foodxpress, a merchant, pharmacy or delivery partner may refuse an item that appears unsafe, unlawful, incorrectly described or unsuitable for transport.
6. Prices, charges, and payment
Prices, taxes, delivery fees, service fees, tips, and other charges shown before confirmation may depend on distance, demand, merchant pricing, and order details. You authorize the selected payment method to be charged for the final amount. Where cash payment is available, you must pay the amount due at delivery.
7. Cancellations, refunds, and corrections
Cancellation or refund eligibility depends on the order status, merchant preparation, delivery progress, payment method, and circumstances. Charges may apply after a merchant or delivery partner has begun fulfilling a request. Report missing, damaged, incorrect, or undelivered items to Foodxpress support promptly so the matter can be reviewed.
8. Delivery and access
You must provide a complete and accessible address, remain reachable, and arrange lawful access to the pickup or delivery location. Estimated times are not guaranteed and may change because of traffic, weather, availability, merchant preparation, or other conditions. If delivery cannot be completed because the recipient is unavailable or the information is incorrect, additional charges or return arrangements may apply.
9. Acceptable use
You may not misuse the services, submit false information, interfere with the platform, harass or threaten another user, evade charges, commit fraud, infringe another person's rights, or use Foodxpress for unlawful activity. You must treat merchants, delivery partners, customers, recipients, and support personnel respectfully.
10. Communications
You agree that Foodxpress may send service-related messages by email, SMS, telephone, or in-app notification, including account verification, order updates, security notices, and support communications. Message and data rates may apply. Marketing messages, where used, will be handled according to applicable law and available preferences.
11. Intellectual property
The Foodxpress name, logos, apps, website, software, and original content are owned by or licensed to Foodxpress and are protected by applicable intellectual property laws. You receive a limited, personal, revocable, non-transferable right to use the services for their intended purpose.
12. Service availability and disclaimers
Foodxpress aims to provide reliable services but does not guarantee uninterrupted access, continuous availability of merchants or delivery partners, or error-free operation. To the extent permitted by law, the services are provided on an “as available” basis. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by law, Foodxpress is not liable for indirect, incidental, special, or consequential loss arising from use of the services. Any liability that cannot be excluded is limited only to the extent permitted by applicable law.
14. Suspension and termination
Foodxpress may restrict, suspend, or terminate access where reasonably necessary to protect users, investigate suspected fraud or unlawful conduct, enforce these terms, address payment issues, or protect the platform. You may stop using the services and request account deletion as described on our Account Deletion page.
15. Changes to these terms
Foodxpress may update these terms as the services or legal requirements change. The updated effective date will be shown on this page. Where required, we will provide additional notice. Continued use after an update takes effect means you accept the revised terms.
16. Governing law
These terms are governed by the laws of Belize, subject to any mandatory consumer protections that apply to you. The parties should first attempt to resolve disputes through Foodxpress support before pursuing other remedies available under applicable law.
